Terms & Conditions for Hibiki Pty Ltd (Freedom Academy)

1. Introduction

Freedom Academy™ (“we”, “us”, “our”) is a program delivered by Hibiki Pty Ltd (ABN 40 675 402 203) and the person named below (“you”, “your”).

By enrolling in Freedom Academy™, you agree to be legally bound by these Terms and Conditions. Enrollment confirms your commitment to a 12-week minimum service period (the “contract period”).

2. Services Provided

As part of your enrollment, you will receive:

  • Access to the Freedom Formula™ Curriculum (accelerator-level sales training modules)

  • Group coaching and facilitated sessions to support your career goals

  • Membership in the Freedom Fighters private community

  • Access to digital program resources and support.

3. Contract Period

Your 12-week contract period commences upon signing this e-document.

During the minimum service period, you cannot suspend, pause, or place your program or payments on hold.

4. Refund Policy

The establishment fee is non-refundable under all circumstances.

There is no cooling-off period, change-of-mind option, or cancellation available during your minimum term.

5. Payment Options

You may choose to pay in full, via an instalment plan, or through an approved third-party finance provider.

Finance arrangements are between you and the provider and may involve additional costs.

Freedom Academy™ is not responsible for any terms or conditions set by third-party finance providers.

6. Ongoing Membership

Upon completion of your 12-week minimum service period, unless otherwise advised by you in writing, Freedom Academy™ will automatically transition you into the Freedom Fighters Membership, which operates on a rolling 30-day basis.

Ongoing monthly debits will continue from your nominated credit card for uninterrupted access.

To terminate ongoing services, written notice must be provided to [email protected] with a 30-day notice period.

7. Cancellation & Default

At the conclusion of your minimum service or notice period, if you cancel your membership, all access to resources, community, and coaching will be revoked.

If you cancel, stop, or default on your payments at any time during the contract period, you will be removed from the program immediately and will not be eligible to rejoin for a minimum of 12 months.

If re-entry is approved after that time, a Reactivation Fee applies.

8. Behaviour Policy

Freedom Academy™ reserves the right to remove any member from the program for unethical, disruptive, or abusive behaviour toward staff, coaches, or other members. No refunds will be issued in this case.

9. Intellectual Property

All materials, systems, and frameworks provided through Freedom Academy™ remain the exclusive intellectual property of Shane Da Costa and Freedom Academy™.

You are not permitted to reproduce, resell, or distribute program content without written permission.

Any material provided to you that is not in the public domain may not be dealt with without our consent.

10. Privacy

Any personal information provided to us will be handled in accordance with our Privacy Policy.

11. Confidentiality

These Terms and Conditions are private and confidential. They are provided to you for your personal use only and must not be republished, distributed, or shared with any third party without our express written consent.

12. Confirmation of Agreement

By submitting your payment or application, you confirm that you have read and agreed to these Terms and Conditions, and that you accept full responsibility for your participation, payments, and results.
